These Terms of Service ("Terms") govern your access to and use of the non-custodial validator and staking infrastructure service ("Service") provided by NodeDepot ("Operator", "I", "me", or "my"), acting strictly in a personal capacity.
BY ACCESSING OR USING THE SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.
1. Nature of the Service
The Service consists exclusively of non-custodial validator infrastructure.
- Users delegate directly to validator nodes operated by the Operator
- Users retain full ownership and control of their crypto-assets at all times
- The Operator does not custody, access, or control user funds
The Service is purely technical in nature.
2. Delegation Relationship
Users delegate their crypto-assets directly to a validator node operated by the Operator at the protocol level.
Such delegation:
- Does NOT transfer ownership or control of assets
- Does NOT create any contractual management relationship
- Is executed entirely within the blockchain protocol
The user remains the sole and exclusive controller of their assets at all times.
3. Self-Directed Participation
All staking or delegation actions are:
- Initiated exclusively by the user
- Executed through the user’s own wallet
The Operator does not initiate, execute, or control any transaction on behalf of users.
4. No Intermediation
The Operator does not act as:
- Intermediary
- Broker
- Agent
- Custodian
Users interact directly with blockchain protocols.
5. Regulatory Status
To the maximum extent permitted under applicable law:
- The Service is not a regulated crypto-asset service
- The Operator does not act as a Crypto-Asset Service Provider under MiCA
- No financial, investment, or advisory service is provided
Users are solely responsible for their regulatory compliance.
6. No Advice
Nothing provided constitutes:
- Investment advice
- Financial advice
- Legal or tax advice
7. Absolute Risk Assumption
YOU EXPRESSLY ACKNOWLEDGE THAT:
- Crypto-assets may lose all value
- Staking involves technical and economic risks
Including but not limited to:
- Slashing penalties
- Validator downtime
- Smart contract failures
- Network attacks
YOU ASSUME FULL RESPONSIBILITY FOR ALL RISKS.
8. Rewards Disclaimer
Rewards:
- Are generated solely by the blockchain protocol
- Are not controlled or guaranteed by the Operator
The Operator does not promise or advertise returns.
9. No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".
No warranties of any kind are provided, including:
- Availability
- Accuracy
- Fitness for purpose
10. Limitation of Liability
To the maximum extent permitted under Spanish and EU law:
The Operator shall not be liable for:
- Loss of funds or crypto-assets
- Loss of profits or opportunities
- Indirect or consequential damages
Total liability shall not exceed zero (0).
This does not exclude liability that cannot legally be excluded.
11. Indemnification
You agree to indemnify and hold harmless the Operator from any claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your breach of applicable law
12. User Responsibilities
You are solely responsible for:
- Securing your wallet and private keys
- Understanding staking mechanics
- Compliance with tax and legal obligations
13. Service Availability
The Operator does not guarantee:
- Continuous uptime
- Error-free operation
The Service may be interrupted at any time.
14. Modifications
The Operator may modify or discontinue the Service or these Terms at any time.
15. Governing Law
These Terms are governed by the laws of Spain.
Disputes shall be subject to the courts of Madrid, Spain, unless EU law provides otherwise.
16. Severability
If any provision is invalid, the remaining provisions remain in force.
17. Entire Agreement
These Terms constitute the entire agreement between the parties.
